2. Privacy Policy
This Privacy Policy explains how Yundera collects, uses, and protects your personal data.
2.1 Scope
This policy applies to:
- visitors of our website
- users of the Yundera dashboard and billing portal
- customers who subscribe to a PCS
- support communications
It does not apply to data you store inside your PCS (files, apps, databases).

2.2 Personal Data We Collect
We collect only the minimum data required to deliver and support your Yundera service.

2.3 Data We Never Collect
We do not access or collect:
- Files, databases, or application data stored inside your PCS
- Messages, media, or content processed by the apps you install (e.g., WordPress, Jellyfin, qBittorrent)
- Passwords to your apps, unless you explicitly share them with us during support (and even then, we recommend temporary access only)
Your server is yours alone. We don't scan, mine, or monetize your data.
2.4 How We Use Your Data
We use your data to:
- Create and maintain your account
- Provide access to your server and domain
- Process billing and payments
- Send service updates, invoices, and critical notices
- Improve our infrastructure and prevent abuse
- Provide customer support
We never sell, trade, or rent your personal data to third parties.
2.5 Legal Basis (GDPR)
If you're in the EU or other jurisdictions requiring a lawful basis (per GDPR), we process your data on the basis of:
- Contractual necessity: to deliver Yundera services
- Legal obligation: for compliance with tax or law enforcement requirements
- Legitimate interest: for service improvement and security
- Consent: when you opt into marketing or research communications (you can withdraw this at any time)
2.6 Data Sharing and Third Parties
We may share data only when necessary, and only with trusted partners:

We only rely on GDPR-compliant partners.
2.7 International Data Transfers
Your personal data is stored on servers located exclusively in France, hosted by Scaleway.
We do not transfer your personal data outside the European Union.
However, if you access your account or server from outside the EU, certain technical data (such as your IP address or connection information) may cross borders as part of normal internet communication.
In all cases, we ensure that:
- your data remains hosted in the EU
- any incidental transfers comply with GDPR safeguards
- no data is shared with third countries without adequate protection
2.8 Data Retention
We retain your account and billing data as long as your subscription is active, and as required by law (e.g., for financial audits or tax reporting).
Upon account deletion:
- Personal data is removed from our systems within 30 days
- PCS data is deleted permanently if your server is terminated
2.9 Your Rights (GDPR)
You have the right to:
- Access your personal data
- Correct inaccurate data
- Delete your data (right to be forgotten)
- Export your data (data portability)
- Withdraw consent to optional communications
- Object to certain types of processing

2.10 Security
We take data security seriously. Our practices include:
- HTTPS encryption everywhere
- 2FA for admin systems
- Encrypted server provisioning
- Secure DNS and domain routing
- No shared PCS containers — every server is isolated
However, you are responsible for securing your PCS (passwords, SSH keys, app logins, backups).
2.11 Children’s Privacy
Yundera is not intended for children under 16. We do not knowingly collect or store personal data from children. If you believe this has occurred, please contact us for immediate deletion.
3. Terms of Service
These Terms govern your use of Yundera services.
3.1 Service Overview
Yundera provides users with a private virtual server ("PCS") hosted in our partner infrastructure, pre-configured with a secure operating system (e.g., CasaOS) and optional access to a curated open-source app store. Each user receives a server deployed at a custom domain (e.g. yourname.nsl.sh), which they control.
3.2 User Responsibilities
You are fully responsible for:
- all actions performed on your PCS
- the content stored, transmitted, or shared through your server
- any third-party applications you install or configure
- managing your passwords, SSH keys, and access credentials
- keeping your applications updated
- complying with all applicable laws
- maintaining your own backups
Your PCS is under your exclusive control.
Yundera does not access your PCS unless you request it or a legal obligation requires it.
3.3 Open Source Apps
Yundera integrates open-source software provided by third parties. These applications:
- Are distributed under their own licenses (e.g. MIT, GPL, Apache 2.0)
- Are not modified or maintained by Yundera
- May contain bugs, vulnerabilities, or compatibility issues
By installing or using these applications, you agree to be bound by their individual license terms.
Yundera is not liable for any issues caused by third-party open-source software, including data loss, security breaches, or operational failure.
3.4 Acceptable Use Policy
You must not use Yundera services to:
- Violate any applicable local, national, or international law
- Infringe intellectual property rights or facilitate piracy
- Distribute malware, ransomware, phishing links, or conduct cyberattacks
- Engage in harassment, hate speech, or extremist activity
- Store or distribute content that exploits or endangers minors
- Operate spamming, botnets, or crypto-mining operations without consent
Violation of these rules may lead to immediate suspension or termination of your PCS, and reporting to relevant authorities.
3.5 Jurisdictional Compliance
You agree that:
- You will comply with all laws applicable in your country of residence and operation
- You will not use Yundera in jurisdictions where:
- Self-hosting, VPNs, or P2P protocols are prohibited
- Use of open-source software is restricted
- Government licenses are required for foreign cloud access
Yundera reserves the right to limit service availability, block features, or decline deployment in regions where operation may violate local law or international regulation.
3.6 Data Ownership and Privacy
You retain full ownership of all data stored on your PCS.
Yundera:
- Does not access your files, databases, or user data unless required by legal order
- Does not scan, track, or monetize your content
- Provides technical support without entering your server unless expressly authorized by you
You are responsible for securing your data using encryption, backups, and strong authentication.
3.7 Billing and Payment
Yundera services are billed monthly or annually, depending on your selected plan. Billing covers:
- Infrastructure usage (CPU, RAM, storage)
- Domain routing and DNS management
- Optional services (custom domains, VPNs, backups)
Non-payment may result in suspension and eventual deletion of your PCS after a grace period of 30 days
Yundera does not store credit card data directly; all payments are handled securely via third-party processors (e.g., Stripe).
3.8 Backups and Data Loss
PCS deletion is irreversible and results in the permanent loss of all files and applications.
Yundera offers open-source tools like Duplicati for backup and recovery, but the responsibility to:
- Schedule backups
- Download or migrate data
- Prevent accidental deletions
lies entirely with the user.
Yundera is not liable for data loss caused by user action, app malfunction, or force majeure.
3.9 Law Enforcement and Legal Requests
Yundera complies only with valid legal requests issued by French or European courts and competent authorities.
We do not access the content of your PCS unless required to do so by law.
If such a request concerns your server, we will notify you unless we are legally prohibited from doing so.
3.10 Termination
We may terminate service for:
- non-payment
- abusive or illegal use
- security risks

3.11 Security & Updates
Yundera ensures:
- Transport Layer Security (TLS) is enabled by default
- Your domain uses secure HTTPS by default
- Core system components are patched for vulnerabilities regularly
However, you are responsible for:
- Updating third-party applications you install
- Managing user access and SSH credentials
- Implementing secure backup strategies
3.12 Limitation of Liability
To the fullest extent permitted by law, Yundera disclaims all liability for:
- Indirect, incidental, or consequential damages
- Data loss or corruption
- Downtime or service interruption
- Incompatibility between open-source apps
- Legal actions due to user behavior
In any case, Yundera's total liability will not exceed the amount paid by you in the previous 12 months.
3.13 Warranties and Disclaimer
Yundera is provided "as is" and "as available."
We make no warranties about:
- Continuous uptime
- Error-free performance of third-party apps
- Compatibility with all devices, browsers, or networks
You use Yundera at your own risk.
